Terms & Conditions of Sale

By using our website you are agreeing to abide by the following terms and conditions. By purchasing goods on our website, you are entering a legally binding contract between yourself and Charlotte Keating England.

Payment & Availability

We accept credit/debit card payments by VISA, American Express and MasterCard or you may checkout using your PayPal account If you have one.

Or you can pay over the phone using our secure Square payment system.

Unless otherwise agreed between Charlotte Keating and the purchaser, all items must be paid in full before the purchaser's order is processed. Once payment has cleared, the purchaser's items will be dispatched. We accept payment through the PayPal secure payment facility.  You may checkout by logging in with you PayPal account or by simply using one of the accepted credit or debit cards. You don't need to have a PayPal account to purchase from us. 

PayPal, Amazon Pay and Shopify Pay are our Payment Service Providers. We pass on some of your details to for the sole purpose of processing your order. 

All prices are quoted in Pounds Sterling and are exclusive of excise duty where applicable.

Delivery costs will be estimated at the first checkout stage and added once you have inserted your delivery address details. You will then be able to complete your order with the confirmed shipping charges.  

Prices relate to Internet purchases only. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

The purchase of goods is subject to availability. Each garment lists the stock status. Where your selected product is not available, we will notify you as soon as possible. A full refund will be given where you have already paid for the goods.

Once your order has been received by Charlotte Keating, you will receive an email from us thanking you for your custom and providing details of the items in your order for your reference. Please save or print a copy for your records.
When you pay using a credit card, you will receive an additional email from our payment service provider, PayPal, providing a receipt of your payment.

For the avoidance of doubt, receipt of an order via our website does not constitute acceptance of an order.

Art Class Booking

Dates for art classes have been offered under each product. In order to run classes where dates have been offered, I require a minimum of two students. If I'm unable to meet this minimum requirement, you will be offered an alternative date or the option to receive a full refund. If there is no date, simply enquire using the contact form and suggest a time you would be available to take the course and I will see if I can schedule a class that day.

Delivery Information

All purchased artwork is carefully packaged for travel, giftwrapped to make it extra special when opening and is shipped using a trackable, insured service.

    All product prices are exclusive of delivery charges which will be presented separately and calculated at time of checkout unless stated otherwise in the product listing.

    UK Delivery:
    All orders are shipped by a carrier of our choice, are fully insured and aim to be delivered to you between 1-4 days after dispatch. Smaller items are usally sent using Royal Mail and larger canvases with a courier. Shipping costs are calculated at Checkout and up to date pricing and inco can be found here

    Click and collect also available at checkout.

    International Delivery:

    We deliver Worldwide.  The logistics of shipping artwork internationally is actually quite tricky! Therefore the delivery costs displayed at checkout are best estimates. If the actual shipping costs vary more than £10 from those paid during the checkout process, you will be credited the difference or invoiced for the correct amount prior to dispatch. You will have the option to cancel at that time if you wish.

    For more economical shipping, I can remove the canvas from the stretcher bars and send it rolled -  simply drop me an email before or after checkout so that I can make the adjustment.

    Rest assured, all this is quite normal practice when buying original art online and you can always contact me in advance for accurate shipping quote.

    Please be aware that local import duties may be payable on receipt and that you, the purchaser, are responsible for paying these.

    Dispatch

    It's important to me that your artwork  is carefully and securely packaged for travel so that it reaches you safely.

    I aim to dispatch smaller paintings within 4 working days upon receipt of your order.

    Medium to large paintings need a little extra time to be packaged and will be dispatched within 10-14 working days upon receipt of your order. Of course if I can ship them sooner, I will!

    If you need something by a specific date, please message me and I'll do my best to meet your deadline.

    Delivery dates specified by Charlotte Keating  are approximate and any claims arising as a result of our inability to meet specified dates are excluded. Charlotte Keating England is entitled to make delivery of the goods in installments.

    Time for the delivery will not be the essence of the contract. We cannot be held responsible for losses or inconveniences caused as a result of delays in deliveries by us or our suppliers.

    All item prices are exclusive of delivery charges which will be presented separately and calculated at time of checkout. We currently deliver worldwide however delivery dates may very for locations out-with the UK and local import duties may be payable on receipt. In the event that you require delivery to an address out-with the UK, we will advise you of an approximate delivery date.

    All products are sent by a carrier of our choice. A signature will be required to acknowledge delivery on all insured delivery options. The signature of the person accepting delivery at the delivery address will be proof that the person to whom the order is addressed has received the delivery.

    Delivery is deemed sufficient if the courier of our choice has attempted delivery when the purchaser or purchaser’s representative is not at the delivery address at the time of delivery. In most cases where a signature is required, the courier will leave an ‘attempted delivery’ notification for the purchaser. Should it prove necessary, it will be the purchaser’s responsibility to arrange for re-delivery of goods or collection of goods from the mail depot.

    On delivery of the goods the purchaser of the goods becomes responsible for any losses or damages arising as a result of their use however they may arise.

    Passing of Property

    The title of the goods does not pass to the customer until the full payment has been made by the customer, received by us and the goods delivered.

    Passing of Risk

    The risk in the products will pass to the customer on delivery. The risk in this context is taken to mean any damage or cost arising as a result of the purchased products to either the purchaser, the purchasers property or to any other third party or property.

    Cancellation

    You have 7 working days, from the date of placing your order, in which to cancel your order. To cancel an order, please write to us at:

    Returns & Refunds

    I'm confident you'll be thrilled with your artwork and find it's better than expected but I want to make the purchase as risk free for you as possible. So if your order is not quite what you expected or just doesn't fit in with your colour scheme or decor, you may return it*.  Simple. This offer does not apply to made to order printed goodies or custom paintings. 

    *Our printed goodies in the Gift Shop are made to order and supplied through a print on demand service, shipped directly from them therefore I'm afraid I can't accept returns on these items. Please check the listing for the words Made to Order. 

    3 easy steps to return:
    1. Please email hello@charlottekeating.com with the subject title "returns request" with your order number
    2. Ensure the items are undamaged and package the items safely for postage and include your contactl details and order number. You can reuse the packaging it came in for this
    3. Arrange for a courier to collect the parcel and return to us insured. We receomend a service like https://uk.interparcel.com, https://www.parcel2go.com or https://www.parcelmonkey.co.uk.

    It will be your responsibility to pay for all return postage charges and ensure the parcel reaches us safely. For your protection, it's important that you obtain a courier collection receipt in case the returned goods are lost or delayed in the post and you need to claim compensation.

    Please reuse our packaging to post back your returns and ensure it's securely wrapped and packaged for travel. Please ensure the compensation level of insurance is appropriate to cover the value of the artwork. This will enable us to action your refund or replacement should the returned goods be lost or delayed in the post. Goods returned to Charlotte Keating are returned at the purchaser's risk. You can either do this by visiting your local post office or arranging collection by an affordable courier through a broker like Interparcel.

    We're happy to offer a refund provided the products are received by us undamaged and in their original condition within 14 days of receipt (7 days for sale items). No goods shall be returned to us unless they are in no less condition that when we delivered them. 

    In cases where the return is due to a discrepancy in the order (as in we've sent you the wrong thing or it's damaged) you will not be responsible for the return delivery charge. When the return arrives back at our premises it will be assessed and should we conclude that the products are faulty or that there was a discrepancy in the order, the return delivery charge will be credited back to you.

    Once we have confirmed that the items are in resaleable condition, any refunds will be credited to the original payment method within 20 days. Please note that on returning part of a set, your discount will no longer be applicable to the remaining items. 

    *I'm afraid I can't offer returns on commissions or bespoke items made to order due to the personal specifications. Our printed goodies are made to order and supplied through a print on demand service therefore we can't accept returns on these items.

    Cookies

    Cookies will be used to ensure that items are placed into your Shopping Basket and orders are processed correctly when you use the PayPal payment system. You may be able to set your browser to notify you when you receive a cookie.

    No recognisable personal information is stored in the cookie that can link it back to an individual.

    Payment Security & Data over the Internet

    The Internet is a global network. Therefore there are cases where your data travels internationally, which may include places outside the European Union. We want you to know that if you visit or shop with Charlotte Keating England, you are agreeing and authorising us to process data in this way. In the event that information is transferred outside the UK, we will ensure the security of that information.

    Any card details that you send through the Internet when purchasing with us are encrypted using the industry standard Secure Sockets Layer (SSL) encryption protocol. This is a tried and tested method for protecting your personal information and is very secure. A padlock icon displayed in your browser indicates that you are on a secure website that uses SSL to encrypt the data that you input.

    General

    The reproduction of colours on the website is as accurate as the photographic and production process will allow.

    These terms and conditions may be revised at any time and we reserve the right to do so. You are therefore advised to keep up to date with the contents of these terms and conditions as revisions are binding upon you.

    If any part or parts of these terms and conditions are deemed invalid, void or unenforceable, then that part or those parts will be considered severable from these terms and conditions thereby not preventing the remainder from being enforceable or effective.

    THESE TERMS AND CONDITIONS DO NOT IN ANY WAY AFFECT YOUR STATUTORY RIGHTS RELATING TO FAULTY OR MISS-DESCRIBED GOODS.

    Your local authority Trading Standards Department, Citizen's Advice Bureau or equivalent can provide further information about your statutory rights.

    Governing Law

    Your use of this Site and any purchase by you on this Site of any products will be governed by English Law and will be deemed to have occurred in mainland United Kingdom.

    The UK law is the applicable law.

    Purchaser's default

    In event of any breach of contract by you the purchaser, we will take appropriate legal action against you and if as a result of which we incur any legal fees, such reasonable fees are to be borne by you.
